Rule:

           Consumer Protection Act, 2019 – Liability for negligence. This is a civil precedent                 because: 

         Civil principle:

           There is a claim that can exist after death, but a claim for personal liability will not

          Analysis:

           Consumer sued for medical negligence. Both the doctor and the consumer are dead.              It   is a  question for the Court to determine whether the heirs of the deceased                          negligent individual   may be sued under the CPA. Appointment of amicus curiae                   to assist in statutory interpretation  and scope of liability.


               


 


         Conclusion

        NCDRC proceedings stayed .Supreme Court on whether relatives can be held liable              for    deceased's   negligence.
